Exercising of the right to Coordinate Subsoil Use Activities and Discharging the Obligation to Carry Out Land Reclamation by a Local Self-Government Body
Annotation
Based on the analysis of judicial practice in disputes related to improper performance of duties in the implementation of subsurface use, a gap in the legislation on subsurface resources on the coordination of relevant activities with the local government body has been identified in the article. At the same time, the obligation to eliminate the consequences of unfair behavior of the subsurface user in the form of the formation of accumulated damage objects formed from subsurface use waste may be assigned to local authorities. The revealed shortcomings of regulatory regulation have a negative effect in the implementation of the rights of the local population to a favorable environment, as well as in the exercise of the powers of local governments in this area. Based on the results of the study, proposals have been formulated aimed at eliminating existing gaps and contradictions in legal regulation by making additions to the current legislation on subsurface resources.
