Annotation

The article analyzes constitutional justice as an autonomous element of the mechanism for protecting freedom of economic activity. It proceeds from the idea that the Russian economic constitution is shaped not only by the text of Articles 8, 34, 35 and 55 of the Constitution of the Russian Federation, but also by the doctrinal positions of the Constitutional Court of the Russian Federation, which transform general constitutional provisions into standards of legal certainty, protection of legitimate expectations, proportionality of public interference and judicial protection of property claims. The methodological basis of the study includes formal legal, systemic and doctrinal methods. The scientific novelty lies in substantiating the thesis of the secondary constitutionalization of private-law institutions — property, corporate rights, obligations, intellectual property results and digital assets — through the legal positions of the Constitutional Court of the Russian Federation. The article concludes that constitutional justice in the economic sphere protects not commercial interest as such, but a predictable and non-discriminatory legal order within which entrepreneurial freedom acquires stable institutional content.
