The article discusses the legal problems of using digital copies (deepfakes) of deceased actors in audiovisual works and advertising in the Russian Federation. The article analyzes the provisions of the Civil Code of the Russian Federation on the protection of a citizen's image, the practice of their application, as well as the prospects for legislative regulation of voice protection as a personal non-property right. Special attention is paid to the issue of the posthumous exercise of image and voice rights, the discretion of heirs and the need to find a balance between the commercial use of digital images and the protection of the good name of the deceased. The author comes to the conclusion that the current legal regulation is fragmented and that it is advisable to improve it by clarifying the legal nature of the digital image and the discretion of the heirs.
