Reliability of Testimony of Parties to Criminal Proceedings

Annotation

Based on an analysis of appellate courts practice, it has been revealed that parties most often challenge the reliability of testimony (and not other types of evidence). The article examines how general jurisdiction courts assess the credibility of the testimony of a suspect, accused, victim, and witness. It has been established that such an assessment must be consistent with the subject of proof under Article 73 of the Criminal Procedure Code of the Russian Federation: only those pieces of information in testimony that establish the circumstances subject to proof are considered reliable. A five-level scale is proposed to systematize approaches to assessing the credibility of evidence.
