Digital Platform Algorithms and New Rules for Qualifying Crimes Related to Destructive Content (on the Example of Articles 242.1, 110.1, and 110.2 of the Criminal Code of the Russian Federation)
Annotation
The article reviews the criminal law issues of qualifying the dissemination of destructive content in the platform environment on the example of Articles 242.1, 110.1 and 110.2 of the Criminal Code of the Russian Federation. The authors argue that the digital platform is not a neutral channel for transmitting information, but rather acts as a kind of technological intermediary. The authors examined the problems of distinguishing between distribution and public display in a platform environment, establishing intent in the automatic distribution of content, determining the moment of completion of a crime of incitement to suicide, and qualifying organizational activities to create an infrastructure for incitement to suicide.
