This article examines how to ensure the legitimate property interests of minors during notarial certification of property alienation transactions, primarily real estate. This topic is relevant given the high level of conflict in transactions concluded by legal representatives, the frequency of subsequent invalidity disputes, and the lack of a uniform court approach to assessing the child's “benefit” during alienation. This paper describes the legal mechanisms of notarial control and the notary's discretion, examines conflict areas of law enforcement, and focuses on approaches developed in judicial practice and reflected in the scientific literature.
