Legal Regulation of Transport and Logistics Infrastructure: Theoretical Problems and Analysis of Judicial Practice
Annotation
The article discusses current issues of legal regulation of relations in the field of transport logistics, which is a complex system for organizing cargo transportation that includes not only transportation itself, but also freight forwarding, warehousing, insurance, customs clearance, and other related services. Based on an analysis of current court practice in the Supreme Court of the Russian Federation and arbitration courts, the article identifies key legal conflicts related to the determination of parties' responsibilities, the classification of contracts, the distribution of risks, and the proof of circumstances. The article concludes that there is a need for a systematic approach to the regulation of logistics services and the formation of uniform court practice.
