Civil Procedure Digitalization: Opportunities and Risks
Annotation
The article is devoted to the study of modern trends in the influence of digital technologies on the organization and implementation of civil proceedings. The article examines the positive and negative aspects of the information revolution affecting the administration of justice. The author focuses on the prospects for the transition from the traditional format of court proceedings to a remote mode using modern technical means, such as web conferences. An in-depth analysis of the issues of compliance with the fundamental principles of justice, such as legality, publicity and equality of the parties, in the context of the active digitalization of judicial processes. Much attention is paid to changing approaches to the collection and evaluation of evidence in electronic format, the emergence of new information transmission mechanisms and features of electronic communication. An assessment of practical examples of the use of digital technologies in real-world litigation is presented, demonstrating the real risks and benefits of their widespread use.
