Proving Authorship of a Digital Photograph in the Practice of the Intellectual Property Court: The Importance of File Metadata
Annotation
The article examines the evidentiary value of digital photo metadata in authorship disputes before the Russian Intellectual Property Court. It analyzes metadata types, their connection with copyright information, the role of original and high-resolution files, and judicial approaches to verifying electronic evidence. The author concludes that metadata should be assessed together with publication history, account data, contracts, and other case materials.
