Procedural Aspects of Consideration of Disputes on Consumer Protection Arising in Distance Selling and Digital Services Provision
Annotation
The article is devoted to the analysis of the procedural features of the consideration of consumer protection disputes arising from distance selling and the provision of digital services. The norms of Russian legislation regulating remote transactions, as well as the positions of the Plenum of the Supreme Court of the Russian Federation and modern approaches of courts to assessing electronic evidence, determining the jurisdiction and distributing the burden of proof are investigated. Particular attention is paid to the problems of legal uncertainty of digital services, the cross-border nature of the interaction of the parties, the role of marketplaces and intermediaries. It is concluded that it is necessary to further improve legislation in the field of e-commerce and digital services, taking into account technological changes and international practice.
