Modern Judicial Practice in Technology Transfer Disputes: Legal Positions and Development Areas
Annotation
The article analyzes the legal positions of the Supreme Court of the Russian Federation, the Intellectual Property Court and arbitration courts of the districts in disputes related to technology transfer and commercialization of intellectual property rights. The author examines issues of pledge of exclusive rights, early termination of legal protection of trademarks, contractual structures in the field of research and development work, as well as the legal status of technology intermediaries. Based on a synthesis of judicial practice and doctrinal approaches, the author identifies directions for improving law enforcement activities that contribute to the formation of an effective technology transfer system in the Russian Federation. The author concludes that judicial approaches are consistently evolving to ensure a balance of interests of all participants in the innovation process and to create a predictable legal environment for the commercialization of intellectual activity results.
