On Problematic Issues of Changing Basic Information about Real Estate Items in the Unified State Register of Real Estate

The article is devoted to the analysis of problems related to the legal regulation of reconstruction and redevelopment of non-residential buildings and structures in Russia. Special attention is paid to the distinction between these legal categories and major repairs. It is established that the Housing Code of the Russian Federation offers clear procedures for changing information for multi-apartment buildings, but the situation with non-residential objects remains unclear and requires more comprehensive legal regulation. The article identifies the problem of the lack of a clear procedure for approving changes in the Unified State Register of Real Estate and the required documentation for non-residential objects, which leads to uncertainty and difficulties for both owners and state registrars. The position is formulated to justify that the amendments made to the Civil Code of the Russian Federation by Federal Law No. 430-FZ of December 21, 2021, have further exacerbated the existing legal uncertainties regarding the division and consolidation of real estate objects. In conclusion, the article emphasizes the need to develop a unified procedure governing the process of redevelopment, reorganization, and reconstruction of non-residential buildings, and suggests possible solutions.
