From Austin to Hart: The History of Critique of the Command Conception of Law

Annotation

The article reconstructs the evolution of criticism of the command concept of law by the founder of legal positivism John Austin. It is noted that the reflection of Austin's legacy began immediately after the publication of the key works of the British lawyer in the academic space of the British Empire. It is concluded that the transition to a new stage in the development of legal positivism in the concept of Herbert Hart became possible thanks to the activities of post-Austinian lawyers.
