Development of International Commercial Arbitration in Russia: Competitive and Geopolitical Aspects
Annotation
In the context of the transformation of the global economic architecture and the intensification of sanctions, international commercial arbitration is no longer a purely procedural mechanism. It is becoming a strategic instrument of economic sovereignty and soft power, directly influencing the investment attractiveness and geopolitical weight of a state. The author substantiates the thesis that Russia possesses unique historical experience and objective prerequisites for creating a powerful regional arbitration hub, in demand by businesses from the EAEU, BRICS+, SCO, Asia, and the Middle East. Based on an analysis of current Russian legislation (fully compliant with UNCITRAL standards and the New York Convention), its geographical location, developed infrastructure, and a strong legal school, the author concludes that significant untapped potential exists. A key condition for realizing this potential is overcoming a number of systemic challenges: confirming the neutrality and independence of arbitration institutions in practice, overcoming the language barrier by integrating official UN languages into procedures, and developing uniform judicial practice in support of arbitration. The article presents a program of specific measures to consolidate Russia's position as a leading arbitration forum through educational and diplomatic expansion, the development of specialized industry rules (including in the digital sphere), institutional reform to enhance the status of arbitration in the judicial system, and the creation of "arbitration symbioses" with partner jurisdictions. The author emphasizes the need to create a next-generation arbitration platform from scratch, integrating blockchain, AI, and smart contracts, which will offer the world not just an alternative, but a more sophisticated, technologically advanced, and customer-focused product.
