Administrative Tort Proceedings as an Independent Type of Administrative Proceedings
Annotation
This article explores the reconceptualization of administrative offense proceedings in courts of general jurisdiction and arbitration courts as forms of administrative enforcement, not just administrative liability. The author combines both judicial forms under the umbrella term “administrative-tort proceedings”, but views them as distinct types of administrative proceedings. At the same time, it is noted that within their frameworks, a single type of administrative process is conducted — the judicial administrative-tort process. For these reasons, it is proposed to align the legislative regulation of judicial administrative-tort proceedings with the administrative process system by developing a unified model for it — the administrative-tort process of the Russian Federation. It must be enshrined in a federal law of the same name and cover legal proceedings in three types of cases: 1) administrative offenses; 2) the resolution of individual issues in administrative offense cases pending before administrative bodies; 3) the adoption of measures to respond to administrative offenses in the absence of an administrative offense case.
