Use of Photographs in the Tourism Industry: Copyright Legal Risks

The article is devoted to the analysis of the triad of legal risks faced by the tourism industry when using visual content: the collision of the institution of panorama freedom with copyright, the contradiction between the public domain regime in copyright and museum legislation, and the phenomenon of “phototrolling”. Based on the analysis of legislation and law enforcement practice, recommendations are proposed to minimize legal risks, taking into account the preservation of the balance of interests of copyright holders and the tourism business. Key recommendations include the creation of a unified federal electronic licensing platform, expanding the use of works for information and tourism purposes, and raising awareness of intellectual property among the tourism industry.
