Specifics of Conducting the "Controlled Delivery" Intelligence and Surveillance Operation under Special Conditions
Annotation
The purpose is to analyze the legal nature, goals and features of conducting an operational-search activity “controlled delivery”. To pay attention to the aspects of the organization and features of the implementation of this activity, its difference from other operational-search activities, as well as the problems of legal and practical nature that arise during its implementation in special conditions. Research methods: comparative legal, dogmatic, description. Conclusions: it is shown that special conditions form a special legal regime for the implementation of controlled deliveries, which differs from conventional operational and investigative activities. It is concluded that controlled deliveries initially involve a higher degree of legal and tactical risk, but in special conditions, this risk becomes systemic, affecting the legal status of the participants, the limits of permissible operational control, the choice of tactical solutions, and the methods of recording results. It is also necessary to have a comprehensive approach to planning controlled deliveries in special conditions, taking into account the multi-stage nature, increased risks, and specific features of operational control.
