Legal Regulation of Actual Admission to Work under the Labor Legislation of Russia and Serbia: A Comparative Analysis
Annotation
This article presents a comparative analysis of the legal regulation of actual admission to work under the labor legislation of the Russian Federation and the Republic of Serbia. It examines the conditions for the emergence of labor relations in the absence of a written employment contract, as well as the specific features of the subject and burden of proof in this category of disputes. Particular attention is paid to procedural time limits for bringing claims in disputes over the recognition of labor relations and their assessment in judicial practice. Conclusions are drawn regarding the advantages and shortcomings of the examined regulatory models and possible directions for their improvement.
