Doctrinal and Legislative Contradictions in the Regulation of the Effect of Contracts (the Problem of Termination of an Executed Contract)

Annotation

The article examines the issue of the relationship between the effect of a contract as a legal fact and the obligations it generates. It analyzes the contradiction between the doctrinal under-standing of a contract as a perpetual basis for obligations and legislative regulation, which ties its termination to the performance of obligations. The author demonstrates that the performance of obligations does not terminate the effect of the contract, as evidenced by the possibility of its sub-sequent termination (e.g., under the Consumer Rights Protection Law). The methods of contract termination (term, condition, dissolution) are examined, emphasizing their independence from the termination of obligations. Special attention is paid to the ambiguity in classifying contracts (con-tinuing/one-time) under current legislation.
