The Right to Parenthood and the Prohibition on Coercion into Parenthood Upon Withdrawal of Consent to Embryo Implantation by One of the Spouses After Its Creation

This article analyzes legal regulation issues arising in the reproductive sphere and related to determining the "fate" of an embryo during a divorce between spouses, one of whom intends to preserve the embryo for use in infertility treatment, while the other renounces their desire to be a parent to a child born through medical treatment. Based on established legal regulations and judicial practice, the author concludes that it is necessary to ensure the safety of the embryo, impose on the patient in whose interests the embryo is preserved the obligation to pay for its cryopreservation, and release the person who has abandoned the embryo from any rights and obligations to it. All of these measures must be established by court order.
