Standard of Proof in the Court's Selection of Strict Preventive Measures: A Continuation of the Discussion

Criminal proceedings are distinctly public in nature and are aimed at resolving a specific legal conflict between society and the individual, protecting society from unlawful attacks. Preventive measures are particularly important in resolving this conflict, as the primary purpose of choosing these measures is to ensure the normal course of the criminal investigation and subsequent resolution of the case. However, preventive measures are not always chosen reasonably, and the court's decision is not always fair. Therefore, it is proposed that the court, when choosing preventive measures, be given the right to examine the validity of the indictment presented by the investigator in court, justifying the need for a strict preventive measure.
