Holders of the Right to Receive Sums of Money Unpaid to the Testator
Annotation
The definition of the circle of persons authorized to receive amounts provided to a citizen as a means of subsistence but not received by him during his lifetime remains relevant. The legislator does not consider these persons to be heirs, granting them an independent subjective right to such amounts regardless of whether they are included in the circle of heirs. An analysis of the special rules for the inheritance of unpaid amounts provided to a citizen as a means of subsistence reveals contradictions between them. The conclusion is substantiated that it is necessary to agree on special conditions and rules for making payments that are means of subsistence. It is proposed to specify the circle of persons entitled to receive such payments and to establish the equality of their shares in the common ownership of these payments.
