Liquidation of Abandoned Mine Workings in the Arctic Zone: On the Introduction of a Special Legal Regime

The article examines the problem of legal support for the liquidation of mine workings whose copyright holder has not been established. The author draws attention to the controversial nature of theoretical approaches to defining the legal nature of mine workings and the inconsistency of legal regulation in this area. The article substantiates the classification of mine workings based on their natural and economic characteristics and the need for differentiated legal regulation of their liquidation, taking into account their classification. The author has studied the causes of the emergence of "abandoned" mine workings, which include gaps in the legal regulation of the liquidation of these objects and the determination of the legal fate of these objects in the event of a change in the legal status of the license holder for subsoil use.The article proposes to refer to underground space (cavity) formed as a result of mining operations and having legal characteristics as an object of subsoil use or an object of negative impact on the environment as a mine workings. The result of the study is the author's conclusion about the need to differentiate the legal regulation of mine workings elimination in order to eliminate the contradictions of legal regulation.
