Who Do Extracted Minerals Belong to?

Annotation

The issue of rights to extracted minerals cannot be considered definitively resolved in Russia, although, at first glance, it seems that there is nothing left to seek in this direction. A person receives a license for the right to use subsoil resources and begins mining. Naturally, it also acquires rights, otherwise why would entrepreneurs invest in development? However, this conviction, no matter what it was formed by, for example, worldly wisdom or an understanding of what is good and just, does not have a solid legal basis. And like any building built on sand, such beliefs crumble if we take a slightly critical look at the legal material associated with the regulation of the relevant relations. The article demonstrates the enormous gaps in existing industry regulation regarding the emergence of rights to extracted minerals, and also provides proposals for amending the legislation in this regard.
