“But You — I’d like You to Stay!”, or the Implementation of Liability Mechanisms for Municipal Heads under the New Local Self-Government Law
Annotation
The article examines the features of the "dual status" of the head of a municipal entity as a person holding a municipal position and a public position of a subject. In particular, the author analyzes in detail the practice of using a mechanism for issuing warnings and reprimands to heads of municipalities for improper performance or non-fulfillment of duties to ensure the exercise by local governments of certain state powers delegated to local governments by federal laws and (or) laws of a constituent entity of the Russian Federation. Examples of the substitution of real claims to the work of heads with transferred state powers are disclosed in detail, and other violations of the procedure for bringing to justice are revealed.
