Non-Regulatory Instruments as a Subject of Challenge in Administrative Proceedings
Annotation
The article deals with topical issues of understanding the legal nature of a non-normative legal act as a subject of challenge in administrative proceedings, distinguishing it from a normative legal act, and from other law enforcement decisions of public authorities. The distinguishing features of a non-normative legal act as a law enforcement decision of a public body are highlighted and it is noted that despite the absence of legal norms in it, its effect may extend to an indefinite range of individuals and organizations. Having analyzed the ratio of non-normative legal acts and other law enforcement decisions, the author comes to the conclusion that it is necessary to recognize in the future the status of a non-normative legal act for all law enforcement decisions of public authorities, which can be ensured through the regulatory consolidation of mandatory requirements for their form and content.
