Registration of Minor Children in Residential Premises Occupied under a Commercial Tenancy Agreement: Problems of Balancing the Rights of the Tenant and the Owner

Annotation

This article provides a comprehensive analysis of the legal consequences of registration (registration) of minor children in residential premises occupied by their parents on the basis of a commercial lease agreement. The purpose of the study is to identify conflicts between the housing rights of minors, derived from the rights of employers-parents, and the powers of the owner of the dwelling. The study revealed that the unconditional nature of the child's right to move in and register, guaranteed by housing and family legislation, creates significant legal risks for the owner, limiting his ability to manage his property and conclude new lease agreements after the termination of previous ones. The author comes to the conclusion that there is a legislative gap, expressed in the absence of effective mechanisms to protect the interests of the landlord in the case of minors, and makes proposals to improve the current legislation aimed at achieving a fair balance of the rights of participants in housing relations.
