Some Issues of Appointing Forensic Examinations and Using Their Results in the Investigation of Crimes Against Sexual Integrity of Minors Committed Within the Family
Annotation
The article addresses current problems and typical errors in the appointment of forensic examinations and the use of expert reports in the investigation of crimes against sexual integrity of minors committed within the family. Based on an analysis of 220 criminal cases and a survey of 550 investigators, the author draws attention to the unjustified choice of examination (appointment of a single-profile examination instead of a complex one and vice versa), inaccurate wording of questions to the expert, and failure to comply with certain procedural requirements. A differentiated approach to the appointment of examinations is substantiated depending on the severity of the crime and the presence or absence of mental pathologies in the minor victim and the adult suspect.
