Annotation

The work is devoted to the study of the characteristic features of evidence in cases related to surrogacy. It has been established that insufficient regulation of the legal foundations of surrogacy determines the complexity of the law enforcement practice of judicial review of relevant disputes. It is determined that the court should reject the traditional approach to the distribution of the burden of proof between the parties to the disputed legal relationship. As a result of the conducted research, the author comes to the conclusion that it is necessary for the court to take an active position during the collection of evidence in the case, providing the necessary assistance to the parties
