The Presumption of Reliability of Documents and Information in Carrying Out Legal Activity in Connection with Falsification of Evidence

The issue of distinguishing between the good faith actions of a lawyer when handling evidence and the criminal offense of forgery has gained particular relevance in light of the law enforcement practices regarding Article 303 of the Criminal Code of the Russian Federation. Although the Code of Professional Ethics for Lawyers establishes a presumption of the reliability of documents and information provided by the client, this presumption does not absolve the lawyer of responsibility in cases of direct intent. Through an analysis of the current legislation and judicial practice, the author delineates the difference between the good faith actions of a lawyer and the elements of the crime defined in Article 303 of the Criminal Code
