Constitutional Law as the Leading Branch of National Law: Critical Notes on a Doctrinal Axiom
Annotation
This article critically examines the leading role of constitutional law in the system of national law, which is considered as an axiom in the Russian constitutional law doctrine. This approach is explained by the mechanical transfer of the special legal features and functions of the constitution to the branch of constitutional law as a whole. The author substantiates the inconsistency of the conventional approach, proposing to consider constitutional law as an ordinary branch of public law, and the law of the constitution as a set of norms from various branches enshrined in the text of the fundamental law and, by virtue of this circumstance, possessing special legal features and a specific legal-technical style.
