Judicial Protection of Labor Rights of Workers in Russia and the Republic of South Africa
Annotation
The article provides a comparative legal analysis of judicial protection of labor rights in the Russian Federation and the Republic of South Africa. Constitutional guarantees, institutional models and law enforcement practices in both countries are considered. It is shown that in Russia labor disputes are considered by courts of general jurisdiction, whereas in South Africa there is a specialized system of labor courts and the Commission for Reconciliation, Mediation and Arbitration (CCMA). A comparison of judicial approaches revealed differences in organizational models and approaches, in particular, to determining the amount of compensation for the dismissal of employees, as well as similarities in recognizing judicial protection as a key way to restore violated labor rights. The conclusion is made about the need for mutual use of best practices: for Russia, the development of specialized bodies and pre–trial conciliation procedures, for South Africa, the improvement of mechanisms for access to justice and shortening the time frame for the consideration of cases.
