The employer may provide the employee with property for the performance of work duties. However, the employee sometimes does not return it. Russian legislation does not allow an employer to demand the return of his property. The article is devoted to the problem of the impossibility of claiming property from an employee. The consequences of the existence of this legislative gap are analyzed, as well as ways to eliminate it are proposed.
