The Established Order and Its Influence on Legal Behavior in the Sphere of Labor
Annotation
This article examines some aspects of the legal behavior of employees and employers. It is shown that, in addition to labor law norms, unwritten rules of conduct, typically developed at the local level over a long period of time, contribute to the formation of the basis for interaction between these entities. This legal phenomenon is proposed to be referred to as established order and considered as a multifaceted phenomenon. Firstly, established order should be interpreted as the development of private autonomy in the sphere of labor, in terms of specifying and expanding the content of legal relations between employees and employers. Secondly, it should be understood as a specific manifestation of the social autonomy of a specific economic entity in terms of the formation of a local legal order in the sphere of labor. Taking into account the multifaceted approach to the concept of established order, it is substantiated that it cannot be reduced to either local customs or labor practices.
