Judicial Discretion within Civil Proceedings

This article contains the author's conclusions based on his research into aspects of judicial discretion in civil proceedings. Judicial discretion is an integral legal tool for regulating procedural relations, as the complexity and diversity of social relations often make it impossible to apply a specific legal norm with absolute clarity. The author formulates two components of judicial discretion: the exercise of discretionary powers and judicial lawmaking. The author also attempts to identify existing standards and limitations that prevent the arbitrariness of judicial discretion. Their analysis served as the basis for another conclusion: the effectiveness of this legal instrument is determined by the need for comprehensive application and improvement of a set of tools. Furthermore, the author assesses the prospects for using AI agents in the standardization of judicial discretion.
