An Analysis of Digital Rights Types Provided for by the Rules of Digital Financial Assets Issue Operators and Exchange Operators
Annotation
The article presents the results of an analysis of the rules of information system operators for issuing digital financial assets (DFAs) and the rules of DFA exchange operators. The rules of these operators are the primary documents governing the functioning of the operators' information systems and, first and foremost, the types of digital rights that can be issued or with which transactions can be executed within these systems. Given that the infrastructure for the issuance and circulation of DFAs is still being formed, and the legislation provides operators with broad opportunities to shape the provisions of their rules, they have established different regulations concerning the issuance and circulation of digital rights. The aim of the study is to analyze the provisions of the rules of Information System Operators and Exchange Operators regarding the issuance of various types of digital financial assets, so-called “hybrid” digital rights, as well as a new digital instrument — foreign digital rights. The results of the analysis are aimed at ensuring a better understanding of the regulation of digital rights by the rules of Information System Operators and Exchange Operators, with the goal of identifying common approaches and differences in the emerging practices of their issuance and circulation.
