Public-Law Aspects of Supervision Algorithmization: On Prerequisites for the Formation of Digital Financial Procedural Law
Annotation
The article examines the formation of a unified system of “end-to-end” preventive algorithmic control in the field of financial legal relations. The author hypothesized a model of institutional unity (integration) of data exchange during a control event (a set of automated verification actions) performed within a legally regulated ecosystem. There is a shortage of legal tools for confirming the correctness (verification) of algorithms for making legally significant decisions in digital ecosystems. The necessity of legalizing the status of investment and settlement platforms (operators of digital ecosystems) is substantiated as «technological control agents». The question is raised about the need to rethink the category of “guilt” in financial law and create a new system of special digital procedural guarantees and protection of violated rights within the framework of the formation of digital financial procedural law.
