Public and Private Interests in Public Procurement: Analysis of Conflicts in Law Enforcement Practice
Annotation
The article is devoted to the analysis of legal conflicts arising in the field of state and municipal procurement. Special attention is paid to the analysis of conflicts in law enforcement practice that arise when evaluating the experience of procurement participants and determining the legal force of explanatory letters from the FAS of Russia. Using the example of the current rulings of the Supreme Court of the Russian Federation, the lack of uniformity in approaches to dispute resolution is demonstrated, which makes it possible to formulate recommendations for improving legislation and law enforcement. The results of the study contribute to optimizing the balance of public and private interests, increasing the efficiency of using budget funds.
