Problems of Reforming Individual and Collective Labor Rights in Brazil: The Experience of the Last Decade

Annotation

The work is devoted to the problems of the implementation of collective labor rights in the Brazilian state, which arose after the reform of 2017. The study provides an analysis of the main legislative innovations in the field of regulation of collective labor rights in Brazil. It is determined that the legislator has changed his position regarding the sources of legal regulation of labor relations, making the system more logical from a formal point of view. At the same time, the legal status of trade unions has also changed significantly, as they are becoming less influential in protecting labor rights. It is concluded that despite the seemingly progressive approaches to regulating collective agreements and the legal status of trade unions, the positions of the latter have significantly weakened, and workers' rights have become more freely and dispositively regulated, which, due to the limited legal possibilities of professional associations, may negatively affect the protection of workers' labor rights.
