Development of Information Systems for Illegal Trafficking in Personal Data: Qualification Algorithms Based on the Target of Crime
Annotation
The article analyzes challenging aspects of application of Part 6 of Art. 272.1 of the Criminal Code of the Russian Federation arising due to vagueness of the target of a crime (information resource, information system, software) and conflicts between criminal -law and industrial (civil, informational) definitions. The author proposes approaches to differentiating between neutral platforms and specialized shadow resources, identifies criteria for the detection of built-in criminal modules in legal systems, specifies the crime completion moment and the range of involved parties, etc.
