The Role of the Constitutional Court of Indonesia in Finding a Balance between Secular and Religious Law
Annotation
Indonesia is a country that demonstrates a form of legal pluralism, in which secular and religious norms coexist. This coexistence can lead to legal conflicts, and the Constitutional Court in Indonesia plays an active role in addressing these conflicts.Based on the Constitution and principles of Sharia (Islamic) law, the court strives to strike a delicate balance between these two systems and ensure their integration into the Indonesian legal framework. However, due to the institutional weaknesses of both the Constitutional Court and religious courts (which are not equipped to handle complex economic disputes), some cases that are directly classified as religious are still handled by secular courts. This situation creates legal uncertainty and undermines the state's efforts to promote a Sharia-based economy.. The experience of Indonesia is significant for Russia in terms of the experiment to establish a legal framework for partnership financing (Islamic banking). This experiment clearly demonstrates that, without the establishment of a specific procedural mechanism for resolving related disputes based on Islamic principles, the development of the institution of Islamic finance will not be possible.
