Annotation

The article discusses problematic issues related to the application of Article 86 of the Family Code of the Russian Federation in terms of recovery of additional expenses from a parent for providing a child with a residential premises. The author analyzes this legal norm from the point of view of its uncertainty, noting its situational nature. The reason for writing the article was the analysis a substantial body of court decisions, as well as the interest in the topic from scientists, which provides a conducive environment for discussion. The author notes that on some issues the conclusions of the courts are contradictory and ambiguous, which requires additional clarifications from the Plenum of the Supreme Court of the Russian Federation.
