Annotation

The article presents an analysis of judicial practice, including the legal positions of the Supreme Court of the Russian Federation and the Federal Antimonopoly Service of Russia on the possibility of applying to the winner of a competitive procurement, who evaded the conclusion of a contract, such type of legal liability as inclusion in the register of unscrupulous suppliers, contractors, performers. Examples of bona fide and unfair actions on the part of the procurement participant, with whom, by virtue of Law No. 44-FZ, the customer is obliged to conclude a contract, are given. The correct classification of such actions will help the procurement participants, officials of the customer and control authorities to make the right decision in a difficult controversial situation.
