The Genesis of Substantive Consolidation in the US Case Law

Annotation

This article analyzes US court decisions that have shaped the doctrine of substantive consolidation. The author examines the stages of substantive consolidation's development in the US and evaluates court approaches to its application. The author concludes that when implementing this concept in domestic legislation, it is necessary to establish that substantive consolidation is only possible when other remedies are impossible, significantly difficult, or futile.
