Theoretical and Legal Aspects of Criminal Law Protection of Military Robotics
Annotation
This article provides a comprehensive analysis of the challenges in criminal law protection of military robotic systems as a new high-tech object of legal regulation. The study examines the theoretical foundations of such protection, including the definition and classification of systems, as well as the specifics of the participants and legal relationships in this sphere. A critical analysis of the applicability of the current norms of the Criminal Code of the Russian Federation is conducted, revealing significant regulatory gaps and conflicts stemming from the absence of specific elements of a crime. The author substantiates the necessity of developing new criminal law provisions that directly criminalize acts such as unauthorized access to control systems, malicious interference with software, and violation of special operational rules. The research also considers the international legal context of regulating autonomous military systems. In conclusion, specific proposals are formulated for improving domestic legislation, aimed at establishing a legal framework that ensures the security and controllability of military robotics.
