The Legal Nature of a Sublease Agreement for Land Plots Between the Management Company of Innovative Scientific and Technological Centers and the Person Participating in the Implementation of the Project
Annotation
This article examines the legal nature of land sublease agreements concluded between the management companies of Innovation Science and Technology Centers and project participants operating within their territories. The study is prompted by a statutory inconsistency identified in Federal Law № 216 of July 29, 2017, concerning the ownership regime of buildings constructed by a participant on a leased land plot. By comparing the Russian framework with Turkey’s regulation of Technology Development Zones, the article argues that such agreements should be classified as innominate mixed contracts incorporating elements of construction (contracting), lease, and concession arrangements. The paper proposes contractual models that ensure a balanced allocation of interests between the management company and project participants.
