Joint Will of Spouses: Specifics and Problems of Law Enforcement

This article examines the theoretical and practical issues arising in connection with the application of the institution of joint wills of spouses. It is determined that a joint will is aimed at exercising the right of citizens to dispose of their property after death. Its content allows us to recognize that its legal nature is heterogeneous, containing elements of various transactions (unilateral and bilateral). The author proposes solutions aimed at improving the effectiveness of the rules governing the institution of joint wills between spouses (prohibiting subsequent cancellation or modification of its terms by one of the spouses, mechanisms to ensure the exercise of the rights of heirs that are considered mandatory, measures aimed at preserving the secrecy of a joint will, and many others).
