Cracks in the Base: Assessing the Effectiveness of Municipal Housing Control in Case Materials (Based on the Cases of the Ivanovo Region and the Republic of Bashkortostan)
Annotation
The draft law No. 958080-9 on the abolition of municipal housing control, submitted to the State Duma on July 2, 2025, necessitates a comprehensive analysis of the effectiveness of this institution and the identification of systemic problems in its operations. The aim of the study is to analyze the judicial practice of the Republic of Bashkortostan and the Ivanovo Region to conduct a comprehensive assessment of the functioning of municipal housing control using the example of two regions of the Russian Federation, and to identify key legal conflicts and the causes of its systemic ineffectiveness. The research has identified and systematized fundamental problems of the municipal housing control institution: 1) legal uncertainty and persistent conflicts in the delineation of competences with state housing supervision; 2) systemic violations of the inspection procedure; 3) passivity and inaction of local self-government bodies, exacerbated by conflicts of interest; 4) the problem of ensuring access to residential premises for control measures; 5) limited functionality, manifested only in the narrow area of controlling utility bill charges.
