The Influence of the Westminster System on the Formation of the Constitution of the Republic of South Africa
Annotation
The article deals with the Westminster system’s influence on building constitutional order in the South African Republic. It is examined historical and legal preconditions of introducing British institutions in the South Africa; features of their transformation during the apartheid regime and democratic transition in the 1990-es and British model elements, remained and modified in the Constitution of the South Africa 1996. The emphasis is placed on departure from the principle of parliamentary sovereignty, enhanced role of the Constitutional court and integration Ubuntu values into modern constitutional identity of the state. Thus, the South African model is characterized by the hybrid system, consisting of the British heritage with local legal and political features.
