The Institute of Coercive Measures to Enforce Compliance with the Laws of the Russian Federation in the System of Legal Guarantees for the Protection of Human and Civil Rights and Freedoms
Annotation
The article focuses on the institution of coercive measures applied to foreign organizations and foreign citizens operating on the Internet within the Russian Federation to ensure their compliance with Russian legislation. This institution was introduced by Federal Law No. 236-ФЗ of July 1, 2021, «On the Activities of Foreign Persons in the Information and Telecommunications Network “Internet” on the Territory of the Russian Federation». It defines the place of this institution within the system of legal guarantees for the protection of human and civil rights and freedoms, and examines its correlation with measures to cease violations and punitive-fine liability measures. The article justifies the significance of coercive measures which, in the context of society's informatization, serve as an instrument for balancing public interest (protecting the rights of the state's residents) and corporate interest (the interests of information resource owners, including digital platforms). The specific features of the mechanism for implementing coercive measures are examined. Based on an analysis of legislative norms and enforcement practice, the paper identifies problems in the regulation of this institution and formulates proposals for its possible future development.
